These Terms of Use (“Terms”) govern your access to and use of the Emberpick® website, including its content, functionality, products, services, and related features.
By accessing or using the website, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the website.
1. Scope of These Terms
These Terms apply to your access to and use of the Emberpick® website and the services made available through it.
Purchases made through the website are also subject to our Purchase Terms, Shipping Policy, Return and Refund Policy, and Privacy Policy, as applicable.

8. Shipping and Delivery
Orders are shipped from China.
Unless otherwise stated on the applicable product or checkout page, our standard shipping framework is:
Order Processing: 1–3 business days
United States Transit: approximately 7–15 business days after shipment
Other International Destinations: approximately 10–20 business days after shipment
Standard shipping costs:
- US$2.99 per order when the discounted merchandise subtotal is US$29.97 or less; and
- Free Shipping when the discounted merchandise subtotal is over US$29.97.
A discounted merchandise subtotal of exactly US$29.97 does not qualify for free shipping.
Shipping and transit times are estimates and are not guaranteed delivery dates.
Delays may occur because of carrier operations, customs processing, weather, public holidays, transportation disruptions, incorrect address information, or other circumstances beyond our reasonable control.

9. Customs, Duties, and Taxes
Where our Shipping Policy states that applicable customs duties, import taxes, or VAT associated with eligible international shipments are borne by Emberpick®, we will handle those charges in accordance with that policy.
Customers remain responsible for providing accurate information reasonably required for customs processing and lawful delivery.
Where a government authority lawfully requires information or action directly from the recipient, the customer may be required to reasonably cooperate.
10. Order Changes and Cancellations
If you wish to request an order change or cancellation, contact:

A cancellation or modification request is not guaranteed after an order has entered fulfillment or has been shipped.
If an order has already shipped, any return will generally be handled under our Return and Refund Policy.

Emberpick® provides a voluntary return period of 30 calendar days after you receive the item, subject to the conditions and procedures described in our Return and Refund Policy.
Customers should contact us before sending a product back so that we can review the request and provide the appropriate return instructions.
Eligibility, return procedures, return-shipping responsibility, damaged or incorrect items, refund processing, exclusions, and statutory rights are governed by our Return and Refund Policy.
Our voluntary return policy does not limit or replace mandatory consumer remedies available under applicable law.

These Terms and your use of the Emberpick® website are governed by and construed in accordance with the laws of the People's Republic of China, without giving effect to conflict-of-laws principles to the extent that such principles would require the application of another jurisdiction's law.
For purposes of this section, the People's Republic of China does not include Hong Kong Special Administrative Region, Macao Special Administrative Region, or Taiwan where those jurisdictions are treated separately under applicable law.
The selection of the laws of the People's Republic of China reflects the fact that Emberpick® is owned and operated by Sichuan Fengcan Shengrun Trading Co., Ltd., a company located in Sichuan, China.
However, this governing-law provision does not deprive a consumer of any mandatory protection provided by the laws of the country, state, province, territory, or other jurisdiction in which that consumer resides where those protections cannot lawfully be excluded, restricted, or waived by contract.
If applicable mandatory consumer law grants you rights or remedies that are more protective than a provision of these Terms, those mandatory rights and remedies will continue to apply to the extent required by law.

Nothing in these Terms requires a consumer to submit a dispute exclusively to a court located in China if applicable law gives that consumer the right to bring a claim before another competent court or authority.
Any dispute that cannot be resolved informally may be brought before a court or other competent authority having jurisdiction under applicable law.
Where permitted by applicable law and where no mandatory consumer-jurisdiction rule applies, courts having jurisdiction over the registered location of Sichuan Fengcan Shengrun Trading Co., Ltd. in Sichuan, China may hear disputes arising from these Terms.
Nothing in this section:

limits a consumer's non-waivable statutory rights;
